TheIntrepid (Pty) Ltd is the responsible party for personal information processed in connection with this website and our business, under the Protection of Personal Information Act 4 of 2013 (POPIA). This notice explains what we collect, why, how long we keep it, who we share it with, and the rights you have.

Personal information we collect

Depending on how you interact with us, we may process:

  • Identity and contact details: name, organisation, role, email address, telephone number and postal address.
  • Enquiry information: the subject of your message, your stated interest (for example investor, management team or adviser), and the content of correspondence.
  • Business and investor information: information you or your advisers provide in connection with a potential or actual investment, mandate or partnership, which may include identification, due-diligence and know-your-client information.
  • Technical information: limited device and log information generated by hosting and security services when you visit the site, and a theme preference stored locally in your browser.
  • Public and third-party information: information from public registers, professional sources and service providers, where this is lawful and relevant to our business.

We do not intend to collect special personal information or children's information through this website. Please do not send us that information via the contact form.

Purposes and lawful bases

We process personal information to:

  • Respond to enquiries submitted through the website or by email, and to maintain a record of that correspondence.
  • Assess, progress or decline potential investments, partnerships and mandates, and to administer existing relationships.
  • Meet legal and regulatory obligations, including FAIS, FICA, tax, company law, PAIA and other financial-sector requirements.
  • Operate, secure and improve this website, and to establish, exercise or defend legal claims.
  • Send information you have requested, or that we are otherwise permitted to send, about our business.

Depending on the context, the lawful bases include your consent (for example when you submit the contact form), performance of a contract or steps prior to entering a contract, compliance with a legal obligation, and our legitimate interests in operating an alternative investment business in a lawful and secure way, balanced against your rights.

Sharing

We share personal information only where it is necessary and lawful, including with:

  • Service providers who host this website, provide email, cloud, professional, legal, audit, compliance or IT services, under appropriate contracts.
  • Professional advisers, co-investors, portfolio companies and counterparties, where required for a transaction or mandate and subject to confidentiality.
  • Regulators, ombuds, courts and law-enforcement agencies when required or permitted by law.

We do not sell personal information.

Retention

We keep personal information only for as long as needed for the purposes above, and for any longer period required by law or to establish, exercise or defend legal claims. Website enquiry records are typically retained for a reasonable period after the enquiry is closed. Records relating to financial services, FICA and investments are retained for the periods required by FAIS, FICA and other applicable law.

Security safeguards

We take reasonably practicable technical and organisational measures to protect personal information against loss, misuse, unauthorised access, disclosure, alteration and destruction. These include restricted access, reputable hosting and email providers, and staff awareness. No method of transmission or storage is completely secure. The contact form on this site currently opens your own email client; the message is sent by you to us and is not stored on the website itself.

Cross-border transfers

Some of our service providers (including website hosting and cloud or email infrastructure) may process information outside South Africa, including in countries that may not have been determined to have adequate data-protection laws. Where that occurs, we take reasonably practicable steps so that the recipient is subject to a law, binding corporate rules or a written agreement that provides an adequate level of protection, as required by section 72 of POPIA, or another permitted ground applies.

Your rights

Subject to POPIA and PAIA, you may request access to your personal information, correction or deletion of inaccurate, irrelevant, excessive, out-of-date, incomplete, misleading or unlawfully obtained information, destruction or deletion of information we are no longer allowed to keep, restriction of processing, and objection to processing on reasonable grounds. Where processing is based on consent, you may withdraw consent, without affecting processing that occurred before withdrawal. You may also lodge a complaint with the Information Regulator.

Cookies and local storage

This site stores a theme preference (light or dark) in your browser's local storage so the site can remember your choice. It is not used to identify you. If we introduce additional cookies or similar technologies that are not strictly necessary, we will update this notice and, where required, obtain consent.

We may update this notice from time to time. The current version will always be available on this page, with the date of the latest update.
